1. OBJECT OF THE CONTRACT

These General Conditions of Sale concern the products offered for sale through our website www.xcvmilano.com
The products for sale available on our Site are made in a limited number of pieces, which constitute the XCV Milano stock. The purchase procedure involves sending an order which is processed by XCV Milano. The purchase will be completed only with the acceptance of the order by XCV Milano. Upon acceptance of the order, you will receive a confirmation email with the link to the Conditions of Sale applied. If the aforementioned stock runs out, the products will no longer be available for purchase as they are out of stock. These products will bear the wording "Sold out" for the period of time necessary for their production and subsequent sale.
By flagging the relevant box when processing the order, you confirm that you have read our General Conditions of Sale and our Privacy Policy.

3. CONCLUSION AND EFFECTIVENESS OF THE CONTRACT

The sales contract is concluded when we send you an email with the order confirmation.
The email will contain your data, the order number, the price of the goods purchased, any shipping costs, the delivery address to which the goods will be sent and the link to print and archive the copy of these Conditions .
You undertake to verify the correctness of the personal data contained in the order confirmation email and to promptly notify us of any necessary corrections or changes.
We undertake to describe and present the items sold on the site in the best possible way, although there may be errors, inaccuracies or small differences between the product depicted on the site and the actual product.
The Customer acknowledges that the colors and representations may differ significantly from the actual product due to the video settings and resolution of the device from which the Site is accessed and therefore the images are to be considered representative only.

4. AVAILABILITY OF PRODUCTS

All products are handcrafted, therefore, the availability of the products refers to the actual availability of the product in stock, at the time the order is accepted.
However, you must always consider that availability must be considered indicative, as:
• an IT anomaly could occur that makes a product available for purchase that in reality is not available, because it is out of production.
Even after sending the order confirmation email sent by XCV Milano, there may be cases of partial or total unavailability of the goods. In this case, we will automatically rectify your order by eliminating the product and will inform you via email of the elimination of the product and the methods of refunding any price paid.

5. PAYMENT METHODS

We accept payments via credit or debit cards, Paypal and Klarna.
When XCV Milano sends the order confirmation, you will be charged the sales price. Every communication and payment takes place through protected and encrypted lines from the banking channels of the payment instruments, according to common security protocols.

6. PRICES

All sales prices of the products indicated on the website www.xcvmilano.com are expressed in Euros (€) and include VAT.

Any shipping costs are not included in the purchase price, but are indicated and calculated at the conclusion of the purchase process before making the payment.
We have the right to change prices at any time, invoicing the goods based on the prices indicated on the site at the time the order is created and indicated in the confirmation email we send you.
In the event of an IT, manual, technical or any other type of error that could lead to a substantial, unforeseen change in the retail price, which makes it exorbitant or clearly negligible, the purchase order will be considered invalid. and cancelled. Any amount paid will be refunded to you within fourteen (14) days from the day of cancellation.

7. RIGHT OF WITHDRAWAL

The law provides that the Customer has the right of withdrawal.
The aim of XCV Milano is to guarantee your complete satisfaction. If for some reason you are not satisfied with your order you can exercise your right of withdrawal, without any penalty, within fourteen (14) working days from the day you received the products purchased on www.xcvmilano.com. The withdrawal costs are borne by the Customer. The products to be returned must be delivered to the courier within fourteen (14) working days from the date of their receipt. The products can be returned by sending the package via the courier indicated by the Seller, only after completing the return authorization request which will be sent to you via email, the same one notified when the order was created. However, it is not possible to change the previously chosen product with another.

Conditions for exercising the right of withdrawal:

1. The return authorization request must be correctly completed and sent to the Seller within fourteen (14) working days from the delivery date;

2. The products must not have been used, worn, washed or damaged;

3. The identification tag and care instructions must be included in the return;

4. Products must be returned in their original, undamaged packaging;

5. Returned products must be sent to the Seller in a single shipment. The Seller, in fact, reserves the right not to accept products from the same order, returned and shipped at different times;

If you have respected all the required conditions, the Seller will refund you the price of the products purchased; however, you will only be responsible for the return costs, i.e. those for returning the purchased products to the Seller. If you decide to use our courier, however, you will not have to pay the return costs yourself, in fact the Seller will pay the courier on your behalf, withholding from the refund a sum equal to the cost previously incurred for delivery of the purchased products to your home. If you decide to use a different shipping method, you will have to pay the return costs yourself. You will be contacted if your return cannot be accepted because it does not comply with the conditions above. In this case, you can choose to have the products purchased back at your expense. If you refuse this shipment, the Seller reserves the right to retain the products and the corresponding amount for the purchase of the products.

7.1 Refund times and methods

After the Seller has received your return and checked that all requirements have been met, you will receive an email confirming acceptance of the return. Whatever payment method you use (credit/debit card, Paypal, Klarna), the refund is activated by the Seller as soon as possible, and in any case within thirty (30) days from the date on which it became aware of the exercise your right of withdrawal, once it has been verified that the withdrawal has taken place in compliance with the conditions set out above. The actual time for crediting or returning the sums paid by you for the purchase of the products depends on the payment methods used. If you purchased by credit/debit card, the refund time depends on the credit/debit card company, but normally occurs within two statements. We remind you that the currency of the credit is the same as the debit, so you will not suffer any loss in terms of bank interest.

7.2 Product identification tag and box

All products offered for sale by the Seller are equipped with an identification tag included in the package, which constitutes an integral part of the goods. We invite you to try the product without damaging the tag and care instructions because returned products that do not have them will not be accepted. Furthermore, returns will not be accepted if the product box is damaged in part or in its entirety.

8. LEGAL GUARANTEE OF CONFORMITY

We try to make use of the best suppliers, carefully selecting the craftsmen who make our products, 100% Made in Italy, but if something escapes our quality control and you receive a defective product or in any case not compliant with the order placed, you will have the right to a refund without costs of product conformity through repair or replacement of the product.
You can exercise this right if the defect occurs within one (1) year of delivery of the goods and you must report the defect to XCV Milano within ten (10) days of its discovery.
To exercise this right, you must send an email to info@xcvmilano.com indicating "Defective_product_return" in the subject line.
In the event of a defective or non-compliant product, we will, at our expense, organize the collection of the product, subject to the Customer's availability.

9. DELIVERY METHODS

We accept orders from all over the world.
The products will be delivered by express courier to the address indicated by the Customer at the time of the order according to the timing indicated in the order acceptance email.
For each order placed on the website www.xcvmilano.com we will issue an invoice for the goods shipped or downloaded. The invoice will be sent via email to the customer after the order has been processed.
The invoice will contain the information you provided to us during the purchase process.
After the invoice has been issued, it will not be possible to make any changes to the data indicated in the invoice.

10. RESPONSIBILITY

We assume no responsibility for disservices attributable to:
• force majeure or unforeseeable circumstances, even if dependent on malfunctions and disservices of the internet network,
• failure to execute the order within the times set out in the Contract.

If one or more provisions of these General Conditions of Sale are considered invalid or declared as such pursuant to the Law, regulation or following a judicial ruling, the other provisions will continue to have full force and effect and the clauses will be interpreted in the sense which will allow them to achieve the purpose for which they were drawn up.

14. APPLICABLE LAW AND JURISDICTION

These General Conditions of Sale are subject to Italian law.
We will try, first of all, to amicably resolve any disputes that may arise, but in the event that we have to take action in a court of law, the jurisdiction will be the Consumer's court, if located in Italy.
