These Terms of Sale apply to those who qualify as Consumers. For professionals (companies, agencies, studios) wishing to collaborate with us, we will send the General Conditions attached to the quote.
We reserve the right to update these Terms of Sale, which will become effective from the moment they are published on the Site.

1. OBJECT OF THE CONTRACT

These General Terms and Conditions of Sale concern the products offered for sale through our website www.xcvmilano.com
The products available for sale on our Site are made in a limited number of pieces, which constitute XCV Milano's stock. The purchase procedure involves placing an order which is processed by XCV Milano. The purchase will be finalized only with the acceptance of the order by XCV Milano. Upon order acceptance, you will receive a confirmation email with a link to the applied Terms of Sale. Should said stock run out, the products will no longer be available for purchase as they are sold out. Such products will display the wording "Sold Out" for the time necessary for their production and subsequent sale.
By ticking the relevant box when processing the order, you confirm that you have read our General Terms and Conditions of Sale and our Privacy Policy.

 

2. PRE-CONTRACTUAL INFORMATION FOR THE CONSUMER (pursuant to Art. 49 Legislative Decree 206/2005)

We have structured our store in such a way as to allow you to view these General Terms and Conditions of Sale, the goods offered for sale, and their characteristics, as described in the respective product sheets.

Before proceeding with order confirmation and payment, we summarize for you:
• The total price of the goods, including taxes, with details of any shipping costs and any other additional costs;
• Payment methods;
• The deadline within which we will deliver the products to you;
• The conditions, terms, and procedures for exercising the right of withdrawal (Art. 6 of these Conditions);
• The information that the Customer will bear the cost of returning the goods in case of withdrawal; 
• The existence of a legal guarantee of conformity for the purchased goods;
• After-sales assistance conditions and commercial guarantees.

3. CONCLUSION AND EFFECTIVENESS OF THE CONTRACT

The sales contract is concluded when we send you an email with the order confirmation.
The email will contain your data, the order number, the price of the purchased goods, any shipping costs, the delivery address to which the goods will be sent, and a link to print and archive a copy of these Conditions.
You undertake to verify the correctness of the personal data contained in the order confirmation email and to promptly communicate any necessary corrections or modifications to us.
We undertake to describe and present the items sold on the site in the best possible way, even if errors, inaccuracies, or small differences between the product depicted on the site and the real product may occur.
The Customer acknowledges that colors and representations may differ significantly from the actual product due to video settings and the resolution of the device from which the Site is accessed, and therefore the images are to be considered only representative.

 

4. PRODUCT AVAILABILITY

All products are handcrafted; therefore, product availability refers to the actual availability of the product in stock at the time the order is accepted.
However, you must always consider that availability should be considered indicative, as:
• an IT anomaly could occur that makes a product available for purchase that is actually not, because it is out of production.
Even after XCV Milano sends the order confirmation email, partial or total unavailability of the goods may occur. In this event, we will automatically rectify your order by eliminating the product and will inform you by email of the product's elimination and the methods for refunding any price paid.

5. PAYMENT METHODS

We accept payments via credit or debit cards, Paypal, and Klarna.
Upon sending of the order confirmation by XCV Milano, you will be charged the sales price. All communication and payment occur through secure and encrypted lines via the payment instrument's banking channels, according to common security protocols.

 

6. PRICES

All sales prices of products indicated on the website www.xcvmilano.com are expressed in Euros (€) and include VAT.

Any shipping costs are not included in the purchase price, but are indicated and calculated at the time of completing the purchase process before payment.
We have the right to change prices at any time, invoicing the goods based on the prices indicated on the site at the time of order creation and indicated in the confirmation email we send you.
In case of an IT, manual, technical, or any other error that may lead to a substantial, unforeseen change in the public sales price, making it exorbitant or clearly negligible, the purchase order will be considered invalid and canceled. Any amount paid will be refunded within fourteen (14) days from the day of cancellation.

 

7. RIGHT OF WITHDRAWAL

The law provides that the Customer has the right of withdrawal.
XCV Milano's goal is to ensure your complete satisfaction. If for any reason you are not satisfied with your order, you can exercise your right of withdrawal, without any penalty, within fourteen (14) working days from the day you received the products purchased on www.xcvmilano.com. Return costs are borne by the Customer. Products to be returned must be delivered to the courier within fourteen (14) working days from the date of their receipt. Products can be returned by shipping the package via the courier indicated by the Seller, only after having completed the return authorization request that will be sent to you via email, the same one notified at the time of order creation. However, it is not possible to exchange the previously chosen product for another.

Conditions for exercising the right of withdrawal:

1. The return authorization request must be correctly completed and sent to the Seller within fourteen (14) working days from the delivery date;

2. Products must not have been used, worn, washed, or damaged;

3. The identification tag and care instructions must be included in the return;

4. Products must be returned in their original, undamaged packaging;

5. Returned products must be sent to the Seller in a single shipment. The Seller reserves the right not to accept products from the same order, returned and shipped at different times;

If you have met all the required conditions, the Seller will refund the price of the purchased products; however, only the return costs, i.e., those for returning the purchased products to the Seller, will remain at your expense. If you decide to use our courier, you will not have to pay the return costs yourself; the Seller will pay the courier on your behalf, retaining from the refund an amount equal to the cost previously incurred for the delivery of the purchased products to your home. If, on the other hand, you decide to use a different shipping method, you will have to pay the return costs yourself. You will be contacted if your return cannot be accepted because it does not comply with the conditions mentioned above. In this case, you can choose to have the purchased products back at your expense. Should you refuse this shipment, the Seller reserves the right to retain the products and the corresponding amount for the purchase of the products.

 

7.1 Refund timing and methods

After the Seller has received your return and checked that all requirements have been met, you will receive an email confirming acceptance of the return. Regardless of the payment method you used (credit/debit card, Paypal, Klarna), the refund is activated by the Seller as soon as possible, and in any case within thirty (30) days from the date on which it became aware of the exercise of your right of withdrawal, once it has been verified that the withdrawal took place in compliance with the conditions described above. The actual time for the re-crediting or return of the sums you paid for the purchase of the products depends on the payment methods used. If you purchased with a credit/debit card, the refund time depends on the credit/debit card management company, but normally occurs within two billing cycles. Please note that the re-credit currency is the same as the debit, so you will not incur any loss in terms of bank interest.

7.2 Product identification tag and box

All products sold by the Seller are equipped with an identification tag included in the package, which constitutes an integral part of the item. We invite you to try the product without damaging the tag and care instructions because returned products without them will not be accepted. Furthermore, returns with product boxes damaged in whole or in part will not be accepted.

 

8. LEGAL GUARANTEE OF CONFORMITY

We strive to use the best suppliers, carefully selecting the artisans who make our 100% Made in Italy products, but should something escape our quality control and you receive a defective product or one that does not conform to the order placed, you will be entitled to free restoration of the product's conformity through repair or replacement of the product.
You can exercise this right if the defect appears within one (1) year from the delivery of the goods and you must report the defect to XCV Milano within ten (10) days of its discovery.
To exercise this right, you must send an email to info@xcvmilano.com with the subject "Defective_product_return".
In case of a defective or non-conforming product, we will, at our expense, arrange for the collection of the product, compatible with the Customer's availability.

 

9. DELIVERY METHODS

We accept orders from all over the world.
Products will be delivered via express courier to the address indicated by the Customer at the time of order according to the timing indicated in the order acceptance email.
For every order placed on www.xcvmilano.com, we will issue an invoice for the goods shipped or downloaded. The invoice will be sent via email to the customer, after the order has been processed.
The invoice will contain the information you provided us during the purchase process.
After the invoice has been issued, no changes can be made to the data indicated therein.

 

10. LIABILITY

We assume no responsibility for disservices attributable to:
• force majeure or unforeseeable circumstances, even if dependent on malfunctions and disservices of the internet network,
• failure to execute the order within the times provided by the Contract.

 

11. ACCESS TO THE SITE

You have the right to access the site for consultation and making purchases. No other use, especially commercial, of the site or its content is permitted. The integrity of the elements of this site, whether audio or visual, and the related technology used remain the property of XCV Milano and are protected by Copyright and intellectual property laws.

 

12. COOKIES

The website www.xcvmilano.com uses "Cookies". Cookies are fragments of information relating to the Customer's navigation on the site (pages visited, date and time of consultation, etc.) and allow XCV Milano to offer a personalized service to its customers.
We inform you that you can deactivate the creation of such files by accessing your Internet configuration menu.

13. SEVERABILITY CLAUSE

These General Terms and Conditions of Sale consist of all the clauses that compose them. If one or more provisions of these General Terms and Conditions of Sale are considered invalid or declared as such pursuant to Law, regulation, or following a judicial decision, the other provisions will continue to have full force and effect, and the clauses will be interpreted in a way that allows them to achieve the purpose for which they were drafted.

 

14. APPLICABLE LAW AND COMPETENT COURT

These General Terms and Conditions of Sale are governed by Italian Law.
We will first try to amicably resolve any disputes that may arise, but in the event that we have to resort to a judicial body, the jurisdiction will be the Consumer's forum, if located in Italy.
